The Tobacco & Vapes Bill represents the most significant regulatory overhaul the UK vape industry has seen. Having passed its second reading in the House of Lords, the Bill is now progressing through Committee stage, with implementation timelines becoming clearer by the month.
For vape businesses, the changes ahead are potentially substantial. The Bill is expected to introduce or strengthen requirements around advertising restrictions, standardised packaging, enhanced display and labelling rules (including updated Classification, Labelling and Packaging Regulation (CLP) requirements), and new retail licensing schemes. Perhaps most significantly, there’s likely to be a shift away from the current MHRA notification system towards a more comprehensive product registration framework.
Running parallel to these changes is the HMRC Vaping Duty Stamp Scheme, which takes effect from October 2026. This isn’t just a new tax, it’s a fundamental change to how products are packaged and sold. Every retail pack will need a secure, scannable stamp that physically seals the packaging. If the seal is broken or tampered with, the product becomes illegal to sell.
